Preferred term
minimization provision
Definition
- In accord with the particularity requirement of the Fourth Amendment, Title III of the Omnibus Crime Control and Safe Streets Act of 1968 contains a provision requiring officers to minimize the recording of conversations that are not related to the investigation of crimes for which they have secured wiretaps. Although the law also requires the suppression of such conversations at trial, some commentators believe this element of the law has been undermined both by establishment of good faith exceptions to the exclusionary rule and by the inability of many individuals whose privacy may be violated by such searches to establish standing to vindicate their rights.
