Preferred term

parolees and probationers

Definition

  • Parolees and probationers have a reduced level of Fourth Amendment rights, as courts have reasoned that they have a much lower expectation of privacy than other citizens. The U.S. Supreme Court in several decisions has upheld practices involving search and seizure practices with parolees or probationers that likely would be unconstitutional as applied to citizens who are not on probation or parole.
