  • Constitutional engineering refers, generally, to the process by which political actors devise higher law, which is usually—but not always—specified in a formal written document and labeled the “constitution.” Constitutional design is a close synonym. Any particular instance of constitutional engineering must deal with certain basic questions of organization and process.
