  • In legal parlance, the term garbage search indicates a warrantless search—conducted by law enforcement agents, sometimes with cooperation from regular garbage collectors—of waste that has been placed in a container for purposes of disposal. Over the years, many courts have addressed the question whether this investigative practice violates the Fourth Amendment's proscription against “unreasonable searches and seizures.” As a general rule, in the twenty-first century the answer in each case turns on whether the person who discarded the refuse had a reasonable expectation that it would remain private.
