Definition
- The need to balance individuals' Fourth Amendment rights to be free from unwarranted searches and seizures against an institution of higher education's need to ensure the safety of all of its community members has been the subject of much litigation. One of the most important cases in this area is New Jersey v. T.L.O. (1985), which involved a search at a high school but has been a key precedent for college and universities.
